Terms and Conditions

Please find below our Terms & Conditions in relation to all training sessions with Advanced Motorcycle Skills.

1.    Advanced Motorcycle Skills Rider Training and the Contract

All motorcycle training is provided by Advanced Motorcycle Skills, whose registered office is Hillcrest, Coldharbour Road, Lower Dicker, East Sussex, BN27 3PU ("Advanced Motorcycle Skills" / "AMS" / "We"). 
The "Student(s)" / "Pupil(s)" / "You" are the person(s) confirmed on the order confirmation. "Force majeure" is any situation beyond the control of Advanced Motorcycle Skills, which can be, but is not limited to, war, terrorist activity, natural disaster, civil strife, fire, adverse weather or road conditions

AMS reserves the right to decline any booking at their discretion.  

Prior to your initial session, You are required to sign our Release and Waiver form and in doing so you are also acknowledging these Terms and Conditions.  Variation of the terms of this contract is only valid if completed in writing and signed by both You and an authorised representative of AMS.  The contract and all matters arising from it are subject to English law and the exclusive jurisdiction of the English Courts.  In the event that any of the provisions of this contract shall be determined by any Court to be invalid, unlawful or unenforceable to any extent then such provision shall to that extent be severed from the remaining provisions of the contract, which shall continue to be valid and enforceable. 

 
2.  Payment

a)   We require full payment in advance on booking, to secure your requested date(s) and service.  Payment can be made using an electronic bank transfer and full details of payment methods are available during your booking.   

c)    What is included in your payment? 

 Individual Training, tuition is on a 1:1/'one to one' Pupil to Instructor basis, unless otherwise agreed in writing prior to commencement. 

d)   Pupils are required to attend training per the dates confirmed when booking.  Any variation to these is only valid if made in writing, by an authorised representative of AMS.

e)   Where a reduced day rate is offered for follow-on days, these only apply provided the additional days are booked and taken within within 3 months of the initial ride. After this the standard day rate applies.

3.   If you wish to cancel or postpone

  Notwithstanding any mutually agreed rescheduling due to poor weather :

a) If cancellation is made with three (3) or more days’ notice before the commencement of the session, the amount you have already paid will be returned to you less a handling fee of 25%.  

b)     If you request a postponement with three (3) or more days noticce, and this is mutually agreed, there will be no charge.   If subsequently the new date is duly cancelled then no refund will be made.

c)   No changes or refunds are permitted with less than three (3) days’ notice.

 
4.    If we cancel or postpone

In certain circumstances, due to poor weather or other circumstances, AMS may have to postpone your session in full or part.  In such a situation, AMS will re-arrange your session to a mutually agreed time.  

 
5.   Your Safety and Responsibilities

a)    Statistics show that motorcycle riding, by its very nature, involves a high degree of risk that can lead to personal injury or death. When booking a session, Pupils must accept these attendant risks and hazards. 

b)   You are at all times, solely responsible for your ride and safety and for adhering to the highway code.   You are also responsible for making sure that you are adequately dressed and protected for motorcycle riding, and agree that any advice or direction given will require your diligence to be applied safely.  If you have any doubt you will ask for clarification before following the advice/direction which may require your stopping safely to do so.

c)    Training is only available to full A or A2 motorcycle licence holders. 
You are obliged to inform us of any physical or medical condition or otherwise that could adversely affect safety or training. 

d)    You must hold and bring your full UK motorcycle licence (A or A2) with you for all your training.  It is your responsibility to ensure that your UK driving licence is valid and in your possession for training.  Should your licence not be valid, or you do not bring it to the session, then you will not be able to take the session; nor entitled to any refund. 

e)    Training is on your motorcycle and it is your responsibility to ensure that your motorcycle meets with all legal requirements for being on the road.  You must provide proof of insurance and MOT (where applicable).  Should you arrive for training on a machine that is not legal; your instructor will not be able to conduct any on-road training.  No refund of fees will be made in such a circumstance.

f)     AMS reserves the right to cancel any tuition should there be a suspicion that the Pupil is under the influence of drink or drugs, or if the Pupil is not legal to ride on the road (e.g. you fail an eye sight test).  AMS also reserves the right to stop tuition at any time when the Pupil is not safe on the road and is not acting in accordance with instructions.  No refund of fees will be made in such circumstances.


6.   Our Responsibilities

For Enhanced Rider Scheme (ERS) sessions, we will provide you with practical motorcycle training in accordance with the DVSA approved training standards.  For Road Skills and Individual Bespoke Training, we will provide you with practical advanced motorcycle training in accordance with RoSPA (Royal Society for the Prevention of Accidents) standards. 

 

7.   Liability

a)   Although every effort is made to ensure your safety during your sessions, you must realistically accept that there is a possibility that an accident may occur that causes loss, damage, expense, personal injury or death to you.  Unless shown to be negligent, your instructor and / or Advanced Motorcycle Skills is not liable to you for any expenses, loss, damage, personal injury or death as a result of any accident that may occur. 

b)   Our liability is limited to any damage caused to the Pupil by our failure to perform the contract or by our improper performance of the contract unless the failure or improper performance was the fault of the Pupil or any other third party or was due to unusual or unforeseeable circumstances which could not have been avoided and this liability is limited to the price paid for the training session.

 
8.   Complaints

If You have a complaint about the training course, in the first instance You must inform the Instructor on the day, so that remedial action can be taken as appropriate. 

Thereafter, You must make the complaint in writing within 5 days of the training session by email to complaints@advancedmotorcycleskills.co.uk .
